Terms and conditions of sale of LÉTIKA

Preamble

The website www.letika.fr is an e-commerce site accessible through the Internet. It is open to any user of this network. It is published by the company SARL SAHLINI, SARL with capital of 7.000,00 euros, whose registered office is located at 29 A, rue de la Basse Canterie – 44120 VERTOU, registered with the Trade and Companies Register of NANTES under the number 488 147 521.

The website allows SARL SAHLINI to offer for sale, cosmetic products to Internet users browsing the website.

The buyer prior to his order, declares to have full legal capacity, allowing him to engage under these terms and conditions of sale.

Any order for a product offered on the website requires consultation and express acceptance of these terms and conditions of sale, but this acceptance is subject to a handwritten signature from the user. In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, made for the application of Article 1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation of the purchase order as specified in article 3.3. hereinafter constitutes an electronic signature which has the same value between the Parties as a handwritten signature.

The products are offered for sale in the following geographical territory: Metropolitan France, Corsica, Monaco, Andorra, DOM-TOM, Switzerland, Germany, Belgium, Italy, Luxembourg, Netherlands, Great Britain, Spain, Austria, Denmark, Ireland, Portugal, Finland, Norway, Sweden, Azores, Madeira, Canary Islands, India, Hungary, Brazil.

It is specified that the user can save or print these general conditions of sale, provided however that they are not modified.

1. Object

The purpose of these general conditions of sale is, firstly, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered and, secondly, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by SAHLINI of the products offered on its website.

The company SAHLINI reserves the right to modify at any time these terms and conditions of sale. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

2. Products and prices

2.1. products

In accordance with Article L. 111-1 of the Consumer Code, the User may, prior to his order, take note, on the webite of LÉTIKA, the essential characteristics of the products he wishes to order.

The buyer selects one or more products among the different categories offered on the letika.fr website.

The offers presented by SAHLINI are valid while stocks last. SAHLINI reserves the right to modify the product assortment based on the constraints of its suppliers.

The photographs, graphics and descriptions of the products offered for sale are only indicative and do not engage the seller.

In the event that a supplier modifies a product, the graphic representation of it does not engage the responsibility of the seller or even affect the validity of the sale.

2.2. Price

The selling prices of products online on the website letika.fr indicated in euros, or in dollars, are those in force at the time of registration of the purchase order by the buyer.

They do not include shipping and order processing fees, charged in addition to the price of products purchased according to the amount of the order. The shipping costs will be indicated before the registration of the order by the buyer.

Prices include the value-added tax (VAT) applicable on the day of the order and any change in the applicable rate will be automatically reflected in the price of products sold by SAHLINI on its website.

For Switzerland, billing will be tax free. At the time of the confirmation of the country of delivery, the invoiced amount will be announced in Duty Free. On the other hand, the buyer will be liable for Swiss customs taxes upon receipt of his parcel.

In case of delivery outside the European Union, the buyer is importer of the product concerned. For all products shipped outside the European Union, customs duties or other local taxes or import duties or state taxes may be required. These rights and sums are not the responsibility of SAHLINI but are the responsibility of the buyer.

The selling prices of the products can be modified by SAHLINI at any time. This change will be reported to the buyer prior to any order.

2.3. Delivery Price and Shipping Costs

For metropolitan France: Colissimo Tracking with guaranteed deadlines of 48 hours (working days Monday to Saturday 12h). This product also includes a traceability of the package, namely a flashing of the bar code at the start and finish, available on the website of LA POSTE www.coliposte.net

The participation in the postage and packing of the parcel for metropolitan France is 7.00 €

The contribution to the postage and packaging costs of the parcel is 12.00 € for Europe; 25.00 € for the rest of the world within the limit of 4 Kg per package.

3. Registration and validation of the order

3.1. Navigation within the website

The user can take cognizance of the various products offered for sale by SAHLINI on its website letika.fr. It can navigate freely on the various pages of the website, without being engaged under an order.

The user retains the cost of telecommunications when accessing the Internet and use of the website.

3.2. order

Any order implies the unrestricted and unreserved acceptance of these general conditions of sale.

From the moment the buyer has registered his order by clicking on the icon “Confirm my order”, it is considered to have accepted knowingly and without reserve the present general conditions of sale, prices, volumes and quantities products offered for sale and ordered.

If the user wishes to place an order, he will choose the different products to which he has an interest, and express his interest by clicking on the “Add to Cart” box.

At any time, the buyer may:

3.3. Final validation of the order

4. Payment

Payment must be made when ordering by the buyer. At no time, the sums paid can not be considered as a deposit or installments.

All orders are payable in euros. The buyer guarantees to SAHLINI that he has the necessary authorizations to use the method of payment he has chosen, when registering the purchase order.

SAHLINI reserves the right to suspend or cancel any order and / or delivery, whatever its nature and level of execution, in the event of non-payment of any sum that would be due by the Buyer, in case of payment incident or in the event of an existing dispute with the buyer.

Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid after a period of ten days from the date of invoice or notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in case of late payment of a previous order and this notwithstanding the provisions hereof.

For any payment, SAHLINI reserves the right to request a photocopy of the identity card of the Buyer and, where appropriate, that of the holder of the payment method used by the buyer. For amounts exceeding 400 euros, SAHLINI reserves the right to request a certified photocopy of an identity document.

As part of the fight against fraud on the Internet, information about your order may be forwarded to any third party for verification.

To pay for the order, the buyer has the following payment methods: credit card, bank or postal check issued by a French bank, transfer or money order.

– Credit cards accepted on the site are: Carte Bleue, Visa and Master Card.

Payments can be made by credit card; they will be realized through the secure PAYBOX® system (payment tool). It uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during transport on the network.

In case of payment by credit card, the account of the buyer will be debited the day of his order.

– Bank or postal checks issued by a French bank :

In case of payment by check, the buyer will make his check payable to SAHLINI. He will specify his order number on the back of the check. He will send this check by mail to the following address :

Only checks issued by a French bank are accepted. SAHLINI will send the products no earlier than 5 working days after cashing the check for the said order, subject to provisions. The cancellation of the order before sending the check is possible by simply sending an e-mail to SAHLINI Customer Service by specifying the order number.

– Money transfers or postal money orders :

In the case of payment by bank transfer or money order, the Buyer will issue his order of the order number concerned. SAHLINI will send the products upon receipt of funds corresponding to the said order.

5. Choice of products

The Purchaser having taken knowledge of the products and their characteristics, marketed by SAHLINI, has under his sole responsibility and according to his needs as they have previously determined before any order, made his choice on the product (s) making the object of his order. In addition, the Buyer knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him.

It is the sole responsibility of the Purchaser, if he does not consider himself competent enough, to be assisted by counsel.

6. Delivery and reception

6.1. General rules

The products will be delivered to the address indicated by the buyer on the order form, destination which must be consistent with the previously agreed geographical area.

By default, invoices are sent to the e-mail address indicated by the customer when they are registered.

Failure to comply with the procedures set out below, no claim of the buyer will be accepted.

6.2. Characteristics of the Colissimo system of the POSTE

The buyer is delivered to his home by his postman. In case of absence, the buyer or the recipient of the product ordered receives a notice of passage of his postman, which allows him to withdraw the products ordered, at the nearest post office, for a period of fifteen days.

The buyer is obliged to check, in the presence of the postman or delivery person, the condition of the packaging of the goods and its contents upon delivery.

In the event that the buyer has any doubt of any nature whatsoever about the condition or the contents of his parcel, he is obliged:

– to apply the Colissimo procedure (in particular to report the damages due, all claims and reserves) and to reject the goods by immediately issuing a finding of anomaly immediately to the Post Office (Statement 170) or to the Post Office on Closer within 48 hours after receiving the package.
– to report these incidents within 48h to SAHLINI at info@letika.fr by specifying the order number.

6.3. Delivery Features by Chronopost or DHL

The buyer is delivered to his home by the deliveryman of the company Chronopost or DHL and electronically signs an acknowledgment of receipt.

In case of absence, the Buyer or the recipient of the product ordered receives a notice of passage, which allows him to contact the carrier to arrange another delivery day.

The buyer is required to check in the presence of the deliveryman the condition of the package and the number of packages delivered.

In case of doubt, he must refuse the package and report these incidents to SAHLINI.

6.4. Time limits

Delivery times, following validation of your order, are as follows:
– Colissimo de la POSTE: for France, 3 to 5 working days; for other countries delivered 5 to 7 working days
– Chronopost and DHL: 2 to 3 working days

Any order confirmed before 3pm, Monday to Friday (excluding holidays), is usually processed the same day within the limits of available stocks. And any order confirmed between Friday noon and Sunday evening is usually processed the following Monday (except holiday).

These deadlines are provided for information only.

Any overrun may not give rise to damages, withholding or cancellation of the order by the buyer.

In any case, and in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum of thirty days from the day following the day on which the buyer registered his order, subject to full payment of the price.

Failing delivery after the expiry of this period, the buyer will have the opportunity to cancel the order. The sums paid by the buyer will be returned to him without delay, to the exclusion of any other compensation.

In case of late delivery compared to the date initially fixed, the buyer must report it in writing (mail, mail) to SAHLINI in order to improve the quality of service that may be offered to him and allow SAHLINI to proceed with an investigation with the carrier.

An investigation with the carrier can take up to 21 working days. If during this period, the product is found, it will be immediately re-routed to the place of delivery designated in the order form. On the other hand, if the ordered product is not found at the end of this period of 21 days of investigation, SAHLINI will proceed at its expense to a new shipment of the products ordered by the buyer.

6.5. Unavailability of Products

Products are offered within the limits of available stocks. In case of unavailability of one of the Products, the Buyer will be informed at the earliest. This information may be notified to him, as far as possible, as follows:
– when establishing his order;
– Following the validation of his order, prior to delivery, by e-mail.
SAHLINI will then arrange with LCL Bank to subtract the price (s) of the unavailable Product (s) from the amount deducted from the Buyer’s bank account, if the payment has been made by credit card. In case of payment by check, SAHLINI will refund by check the overpayment.

In all the aforementioned cases, the Purchaser will have the possibility to cancel his order by requesting either the refund of the sums paid within thirty (30) days at the latest after their removal, by e-mail addressed to info@letika.fr , or the exchange of the unavailable Products. In case of exchange of product, the delivery costs will be borne by the consumer.

7. Right of withdrawal

In accordance with Article L. 121-20 of the Consumer Code, the Buyer has a period of seven days from the date of receipt, to return at his expense, the products ordered, for refund.

The products must be returned to mademoiselle bio in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed, and accompanied by the return number obtained according to the procedure described in the Article 8 below.

When a buyer returns products, any risk related to the return of the product is the responsibility of the buyer.

If the aforementioned conditions are met, SAHLINI will exchange the product or refund to the Buyer, within thirty days, the sums corresponding to the products acquired by him.

8. Return of products by mail

To return an item, the buyer must first contact the company SAHLINI to obtain a return number. It can do it by mail to info@letika.fr, by specifying the number of order and the reference of the articles concerned as mentioned in the delivery order.

Once the return number obtained, the Buyer will send the package concerned to the following address:

SAHLINI will not accept any return package if it is not accompanied by a return number. SAHLINI will not accept parcels sent by postage due. Failure to comply with the procedure outlined above and the times indicated above, the buyer can not make any claim for non-compliance or defect of the delivered products, the products then being deemed compliant and free from defect.

9. Retention of title

SAHLINI retains the full ownership of the products sold until the perfect collection of the price, principal, fees and taxes included.

10. Liability

SAHLINI can not be held responsible for the non-performance of the contract in case of out of stock or unavailability of the product due to a case of force majeure, disruption or total or partial strike including postal services and means of transport and / or communications.

SAHLINI can not be responsible for any loss of data, files. It is the Buyer’s responsibility to make all necessary backups.

11. Partial non-validity

If one or more stipulations of the present general conditions of sale are held for invalid or declared as such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their strength and reach.

12. Non-waiver

The fact for one of the parties not to claim a breach with the other party to any of the obligations referred within these terms and conditions of sale can not be interpreted for the future as a waiver the obligation in question.

13. “Informatique et Libertés”

13.1. Nominative information

The information of personal information collected in the context of distance selling is mandatory, this information is necessary for the processing and delivery of orders and for the preparation of invoices. 15. Governing Law and Jurisdiction

Sales of SARL SAHLINI products are subject to French law. Any dispute relating to the interpretation, execution or breach of the contract concluded between SAHLINI and the Purchaser, even in the case of multiple defendants, will, in the absence of an amicable agreement, be the exclusive jurisdiction of the courts of Nantes.
